SAFNA, Inc. (“MRC Seeds”) warrants that the seeds described and sold are subject to tolerances established by law. THE FOREGOING EXPRESS WARRANTY EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY AND THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION HEREON. MRC Seeds does not warrant that the conventional seed produced or distributed by the MRC Seeds is completely free of genetically modified organisms (“GMO”). Due to events outside the reasonable control of the MRC Seeds, including (but not limited to) adventitious pollen contamination due to pollen drift caused by wind and/or insects, MRC Seeds specifically disclaims any warranty as to complete freedom from GMO. By acceptance and use of the seed, buyer agrees that the MRC Seeds’s liability and the buyer’s exclusive remedy for breach of any warranty shall be limited, in all events, to a return of the purchase price of the seed, and in no event shall the MRC Seeds be liable for any incidental or consequential damages. All claims must be presented within a reasonable time after discovery and in no event more than thirty (30) days after the defect in the seed becomes apparent. The pictures shown on this site and containers labels represents kind only. Variety may differ from the illustration in color, shape, and size. Descriptions, illustrations, photos and disease resistance, etc. are based on the results obtained under favorable conditions and certain races of pathogens/diseases. Notwithstanding the above, all claims shall be submitted within 30 days of invoice date. All claims shall be submitted with the original MRC Seeds packaging. By ordering such seeds, the purchaser acknowledges this limited warranty. MRC Seeds under no event shall be responsible for the crop or lack thereof, or the insurance of any crop failure or loss due to negligence, or the impairment, failure or quality of crop or varietal variance therein, whether such loss results from the breach of the foregoing warranty, from breach of any other provision of the buyers contract for the purchase of any seeds or other merchandise sold by MRC Seeds Company or its affiliates, or from any other cause. Except as specifically stated on this site, neither MRC Seeds nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. Buyer consents to the exclusive jurisdiction of the courts of the British Columbia, Canada and agrees that this agreement shall be governed under the laws of the Province of British Columbia, CanadaThis is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
